1. Application
These Terms and Conditions apply to the online purchase by a private customer (You/you) on the website www.gong.co.uk, owned and operated by Jo Plismy Limited (We/we) a company registered in England and Wales under number 3702664 whose registered office is at 315 London Road, Westcliff-On-Sea, SS0 7BX
2. Prices and VAT
Prices indicated on our website are in GBP and including VAT. Your order will be shipped from one of our warehouses located in the UK or the EU. Different VAT rates may apply depending on the country of origin and the country of destination. In some cases your order will be considered an export and as such no VAT is applicable but you will need to pay the VAT when the order is delivered to you.
3. Delivery
We usually ship orders within 3 to 5 working days. We can ship anywhere but our websites currently only accepts online orders from the EU/EEA. Please contact us to get a quote for other destinations, including the UK. We are committed to provide the most affordable and efficient shipping. Please note that for some larger products, we may use a pallet to secure the products during shipping. In case you receive a damaged packaging, you must check if the product itself has been damaged and it must be notified on the delivery note as well as to us within 48 hours, otherwise the transport insurance will be invalidated and we cannot offer a refund.
4. Returns
For orders placed online, we offer a refund to customers wishing to cancel/return their purchase within 14 days of receiving the goods. You must advise us by email of your wish to cancel and we will confirm the return address to you. Goods must be promptly returned to us in original conditions and in the original packaging. We strongly recommend the use of registered post as well as insurance to cover potential transport damage, as damaged goods will not be refunded. The refund will be processed once the goods have been returned to us and accepted.
5. Faulty products
In case you received a faulty item, we will exchange it free of charge if we are notified within 2 weeks of the delivery date. If the product is out-of-stock we will offer you a refund. Subject to your approval we may also offer you a discount instead of an exchange or a refund. It should be noted that most of our products are handcrafted and reasonable variations between items must be tolerated and will not be accepted as damage.
6. Intellectual Property
You acknowledge that we are the exclusive owner of all copyrights, trademarks and intellectual property rights in relation to our products and you will refrain from using our products or images of our products to reproduce directly or through a third party any of our products or deceptively similar variants.
7. Limitation of liability
Our liability in respect of any delay, damage, defect, including any error in the goods shipped against what was ordered
or any order cancellation shall be limited to the total amount payable for the purchase of the goods.
8. Governing law
These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales. Any dispute arising under these terms and conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.
